Criminal case accused under obligation to stand for test identification: SC

A person accused in a criminal case is under obligation to go for a test identification parade (TIP) during an investigation under the Code of Criminal Procedure and it does not violate any constitutional right, the Supreme Court has held. A bench comprising Justices M M Sundresh and J B Pardiwala made the observation in a judgment by which it dismissed the appeal of a convict in a murder case. The top court said the TIP does not violate the fundamental right of an accused under Article 20(3) of the Constitution which provides that no accused can be compelled to be a witness against himself. The bench said that merely taking part in the TIP does not amount to becoming a witness against himself. "We are of the view that after the introduction of Section 54A in the CrPC referred to above, an accused is under an obligation to stand for identification parade. An accused cannot resist subjecting himself to the TIP on the ground that he cannot be forced or coerced for the same," the benc

Federal judge nixes Donald Trump's bid to move hush-money criminal case

Donald Trump can't make a federal case out of this one. U.S. District Judge Alvin K Hellerstein on Wednesday rejected the former president's bid to move his hush-money criminal case from New York state court to federal court, ruling that Trump's lawyers had failed to meet a high legal bar for changing jurisdiction. Hellerstein found that the allegations pertained to Trump's personal life, not presidential duties that would have merited a move to federal court. The evidence overwhelmingly suggests that the matter was a purely a personal item of the President a cover-up of an embarrassing event, Hellerstein wrote in a 25-page ruling. Hush money paid to an adult film star is not related to a President's official acts. It does not reflect in any way the color of the President's official duties. Hellerstein's decision sets the stage for Trump to stand trial in state court in Manhattan as early as next spring, overlapping with the 2024 presidential primary season in what could be a ...

YES Bank-DHFL scam: Court says nation is victim, denies bail to realtor

A special CBI court here has denied bail to Pune-based builder Avinash Bhosale in connection with a case pertaining to the Yes Bank-DHFL scam, saying the nation is the victim of cheating and criminal conspiracy. The court said that prima facie Bhosale's involvement in this serious economic offence is deep-rooted. While Special Judge M G Deshpande denied bail to Bhosale on June 23, the detailed order was available on Tuesday. The court said that Yes Bank's money, which is basically public money and the wealth of the nation, was usurped. The bank was cheated by wisely hatching criminal conspiracy by accused persons. Money of Yes Bank is the wealth of the Nation. Nation is victim of this offence of cheating and criminal conspiracy, the court said, declining to give relief to Bhosale. The special judge said that the way the fraud was committed, granting bail to the applicant (Bhosale) is not safe and there is every possibility of spoiling the case by tampering with the evidence and ..

Judge to weigh whether Donald Trump's case should be moved to federal court

A US judge is set to hear arguments Tuesday over President Donald Trump's attempt to move his criminal case in New York out of the state court, where he was indicted, to a federal court where he could potentially try to get the case dismissed. Judge Alvin K. Hellerstein will listen to the afternoon arguments, though he isn't expected to immediately rule. Trump's lawyers sought to move the case to Manhattan federal court soon after Trump pleaded not guilty in April to charges that he falsified his company's business records to hide hush money payouts aimed at burying allegations of extramarital sexual encounters. While requests to move criminal cases from state to federal court are rarely granted, the prosecution of Trump is unprecedented. The Republican's lawyers say the charges, while related to his private company's records, involve things he did while he was president. US law allows criminal prosecutions to be removed from state court if they involve actions taken by federal ...

Donald Trump's valet set for arraignment in classified documents case

A valet for Donald Trump is set to be arraigned Tuesday on charges that he helped the former president hide classified documents that the Justice Department wanted back. Walt Nauta was charged earlier this month alongside Trump in a 38-count indictment filed by Justice Department special counsel Jack Smith. Though Trump has already entered a not guilty plea to the charges, a judge postponed the arraignment for Nauta to give him time to find a Florida-based lawyer. The indictment accuses Nauta of conspiring with Trump to conceal records that he had taken with him from the White House to his Florida property, Mar-a-Lago. Prosecutors allege that Nauta, at the former president's direction, moved boxes of documents bearing classification markings so that they would not be found by a Trump lawyer who was tasked with searching the home for classified records to be returned to the government. That, prosecutors said, resulted in a false representation to the Justice Department that a dilige

Donald Trump seeking to move criminal case to federal court, says lawyer

Donald Trump's lawyer said Thursday the former president will seek to move his New York criminal case to federal court, a long-shot bid to avoid a trial in the state court where the indictment was brought. Trump's lawyer, Todd Blanche, said at a hearing on an unrelated issue in the case that Trump's defense team plans to file a motion Thursday asking to transfer the historic case from state court to federal court. Such a move, while rare, would have significant advantages for Trump, including a broader, more politically diverse jury pool than in Manhattan, where voters have heavily favored his Democratic rivals. Trump's lawyers face a Thursday deadline to file paperwork listing their grounds for moving the case 30 days after the April 4 state court arraignment where he pleaded not guilty a month ago to 34 felony counts of falsifying business records. A federal judge would then have to rule whether the case can be moved. Trump's charges, brought by Manhattan District Attorney Alvi

Supreme Court quashes criminal case against SAD's Parkash Singh Badal

The Supreme Court on Friday quashed criminal proceedings against Shiromani Akali Dal (SAD) patriarch Parkash Singh Badal, who died two days ago, and his son Sukhbir Singh Badal in a forgery case, saying the summons issued by the trial court was "nothing but abuse of process of law". A bench of justices M R Shah and C T Ravikumar, which had reserved its verdict on a batch of pleas filed by the Badals and senior Akali leader Daljit Singh Cheema on April 11, quashed the summons issued by the Hoshiarpur trial court in Punjab and upheld by the Punjab and Haryana High Court. SC to decide if mere membership of banned group makes someone criminal

The Supreme Court on Thursday reserved its verdict on a batch of pleas including those seeking review of some verdicts of 2011 which had held that mere membership of a banned organisation will not make a person criminal unless he resorts to violence or incites people to violence. The top court noted that the Union of India was not heard by its two judges-bench when the 2011 verdict was passed reading down section 3 (5) of Terrorist and Disruptive Activities (Prevention) Act, 1987 (now repealed). The top court on February 3, 2011, had acquitted suspected ULFA member Arup Bhuyan, who was held guilty by a TADA court on the basis of his alleged confessional statement before the Superintendent of Police, and said that mere membership of a banned organisation will not make a person a criminal unless he resorts to violence or incites people to violence or creates public disorder by violence or incitement to violence. Similar views were taken by the apex court in two other verdicts of 2011
