WTO meet: Govt to oppose continuation of moratorium on e-comm trade duties

India is not in favour of further continuation of moratorium on customs duties on e-commerce trade at the WTO's meeting in Abu Dhabi later this month as it is impacting the developing countries, an official said on Tuesday. The official said that there is a work programme on e-commerce trade and the members of the World Trade Organisation (WTO) should continue to discuss the issue under that. "We are not in favour of extension. We are in favour of continuation of the work programme. There is a need to look at the subject from a development dimension and not from the eyes of big tech companies," the official said. There is a need to discuss the scope of moratorium as there are revenue implications because of it. As per estimates, the potential tariff revenue losses to the developing countries are about USD 10 billion every year. For India, it could be over USD 500 million every year. "There is a need for a clear definition of e-commerce trade. We need policy space for the sector,"

E-commerce platforms can't become haven for counterfeiters: Delhi HC

An e-commerce platform cannot become a haven for infringers of intellectual property and have such a system which provides an avenue to counterfeiters, the Delhi High Court has said. The court observed that e-commerce websites are commercial ventures and are inherently profit oriented, which is not objectionable, but they have to protect intellectual property rights of others. "An e-commerce platform cannot become a haven for infringers. Men are not angels. Where easy money is visible, the conscience at times takes a nap," said Justice C Hari Shankar in a recent order. "E-commerce websites are commercial ventures, and are inherently profit oriented. There is, of course, nothing objectionable in this; but, while ensuring their highest returns, such websites have also to sedulously protect intellectual property rights of others. They cannot, with a view to further their financial gains, put in place a protocol by which infringers and counterfeiters are provided an avenue to infringe a

Sellers seek FDI in inventory models of e-commerce for export purposes

The e-commerce industry has suggested the government permit foreign direct investment (FDI) in inventory-based model of online trade only for export purposes, a senior government official said on Friday. At present, the country's FDI policy does not permit foreign direct investment in the inventory-based model of e-commerce. It is allowed only in firms that are operating through a marketplace model. Director General of Foreign Trade (DGF) Santosh Kumar Sarangi said that they are working on several steps to promote exports through e-commerce medium. He said that the e-commerce stakeholders have asked the department for the promotion of industry and internal trade (DPIIT) to relook at the FDI policy on this issue. "For export purposes, if these (rules) could be revisited is something that we are requesting the DPIIT to examine and explore... and this could be one step forward for creating the e-commerce export zones that DGFT and its team has been working on," Sarangi said here at a
