Stable dispute resolution with minimum court interference is necessary to attract foreign investment in India, Supreme Court judge Justice MR Shah has said. Speaking at the 2nd Arbitrate in India Conclave - 2023, Justice Shah said growth of global trade increases the importance of Alternative Dispute Resolution as a mechanism for resolving disputes. "Stable dispute resolution is necessary to attract foreign investment in India. Unless there is timely and cost-effective resolution of disputes, India cannot become the hub for international arbitration. Changes in anti-money laundering law can impact foreign investment: CAs

Chartered accountants are seeking clarifications on the finance ministry's recent notification on extending the ambit of anti-money laundering law as it can adversely impact ease of doing business and facilitation of foreign investments. According to industry sources, chartered accountants (CAs) and company secretaries often act as formation agents for foreign companies setting up businesses in India and often provide their own address for communication in the initial phase. They also act as resident directors of the foreign company trying to establish presence in the country and also operate bank accounts on behalf of their clients. Industry sources said there is no way that an accountant can know whether the money that an investor is bringing into India is bonafide or laundered money and verify its source. The Indian real estate sector received USD 26.6 billion as foreign institutional investment during 2017-22 period, a three-fold jump from the previous six years, driven by inflows from USA and Canada with a share of 70 per cent, according to Colliers India. Real estate consultant Colliers India on Friday released a report "High on Investors' Agenda" report that delves into the factors that make India a preferred choice for global investors. Foreign investments in India have been on the rise over the last few years as the industry underwent an overhaul, with major structural, policy reforms inducing transparency and ease of business operations, the consultant noted. As per the data, total institutional investments in real estate rose to USD 32.9 billion during 2017-22 period from USD 25.8 billion in the 2011-16 period. I-T dept to release draft rules for foreign investment in unlisted firms

The Income Tax department will come out with draft rules within the next 8-10 days to specify the class of investors and norms of valuation of foreign investment in unlisted companies, an official said on Tuesday. The Finance Act, 2023, has amended Section 56(2)(viib) of the I-T Act, thereby bringing overseas investment in unlisted closely held companies, except DPIIT-recognised startups, under the tax net. The I-T department will notify the final rules on the so-called angel tax after seeking stakeholder comments on the draft rules, the official said. "The draft rules are expected in the next 8-10 days. Preliminary stakeholder consultation on the subject has been done," the official said. The draft valuation rules would provide for ascertaining the fair market value (FMV) of shares of unlisted companies to levy tax on non-resident investments, an official said. The modification in valuation rules is needed as I-T Act and FEMA provide different methodologies for calculating the FM
