SC extends stay imposed by Bombay HC on order granting bail to Navlakha

The Supreme Court on Friday extended the stay imposed by the Bombay High Court on the operation of its order granting bail to activist Gautam Navlakha in the Elgar Parishad-Maoist links case. A bench of Justices M M Sundresh and S V N Bhatti also directed the top court's Registry to place before Chief Justice of India D Y Chandrachud the National Investigation Agency's (NIA) plea to decide on tagging the petition with cases of other accused. The Supreme Court said it was not inclined to say anything on the merits of the case. The Bombay High Court had on December 19 last year granted bail to Navlakha but stayed its order for three weeks after the NIA sought time to file an appeal in the top court. Navlakha, who was arrested in August 2018, was in November last year permitted by the Supreme Court to be placed under house arrest. He is currently residing in Navi Mumbai. NewsClick case: Delhi Police team questions Gautam Navlakha in Mumbai

A team of Delhi Police has gone to Mumbai to question activist Gautam Navlakha in connection with probe into NewsClick's alleged foreign fundings and anti-India activities, an official said on Saturday. Navlakha will be questioned at his house in Navi Mumbai's Agroli, an official said, adding that the team is led by an assistant commissioner of police (ACP)-level officer. Navlakha, who was on house arrest, was granted bail on December 19 in the Elgar Parishad-Maoist links case. In August, the special cell registered an FIR under the Unlawful Activities (Prevention) Act (UAPA) against news portal NewsClick, alleging that a large amount of funds came from China to "disrupt the sovereignty of India" and cause "disaffection against the country". The investigating agency arrested news portal's founder and Editor-in-Chief Prabir Purkayastha and human resources department head Amit Chakravarty on October 3. Bombay HC grants bail to activist Gautam Navlakha in Elgar Parishad case

The Bombay High Court on Tuesday granted bail to activist Gautam Navlakha, arrested in the Elgar Parishad-Maoist links case. A division bench headed by Justice A S Gadkari said Navlakha's plea seeking bail was "allowed". The National Investigation Agency (NIA) urged the court to stay operation of the order for a period of six weeks so that it could file an appeal in the Supreme Court. The bench stayed the order for three weeks. Navlakha, who was arrested in August 2018, was in November last year permitted by the Supreme Court to be placed under house arrest. He is residing in Navi Mumbai at present. The high court granted Navlakha bail on a surety of Rs 1 lakh. He is the seventh accused in the case to be granted bail. Gautam Navlakha, an accused in Elgar Parishad-Maoist links case, is likely to walk out of the Taloja prison in Navi Mumbai on Saturday, as a special court here issued a release memo to facilitate his month-long house arrest. The special court hearing cases related to the National Investigation Agency (NIA) issued the release memo around 2.15 pm on Saturday. On Friday afternoon, the Supreme Court had rejected the NIA's application and ordered that Navlakha be placed under house arrest "without fail" within 24 hours. SC rejects NIA plea, orders Navlakha to be placed under house arrest

The Supreme Court on Friday rejected the NIA's application and ordered social activist Gautam Navlakha to be put under house arrest within 24-hours after shifting him from Taloja jail in Navi Mumbai. Navlakha is lodged in the jail in connection with the Elgar Parishad-Maoist link case. The anti-terror probe agency had sought recall of the SC order of November 10 for placing Navlakha under house arrest, citing his links to Maoists and Pakistan's ISI. The bench of Justices KM Joseph and Hrishikesh Roy, however, ordered some additional security measures to be put in place where Navlakha will be kept.

SC to hear plea of Gautam Navlakha, probe agency on Fri in Maoist link case

The Supreme Court agreed to list for hearing on Friday a fresh plea of activist Gautam Navlakha, who has not been shifted to house arrest despite the apex court's direction in the Elgar Parishad-Maoist link case. A bench headed by Chief Justice D Y Chandrachud took note of the submissions of a senior lawyer, appearing for Navlakha, that the apex court's direction to keep him in house arrest has not been complied with so far. Solicitor General Tushar Mehta, appearing for the NIA, said that the accused, instead of giving the address of his house, has given the address of the office of the Communist Party and moreover, a separate plea would also be filed. The top court said both the pleas of the probe agency and the accused will be listed together before a bench headed by Justice K M Joseph. The top court had on November 10 allowed the 70-year-old Navlakha to be placed under house arrest owing to his deteriorating health.

Elgar case: Actor Suhasini Mulay stands as surety for Gautam Navlakha

Veteran actor Suhasini Mulay on Wednesday stood as surety for activist Gautam Navlakha, an accused in the Elgar Parishad-Maoist links case, before he could be released from prison and put under house arrest. Navlakha, 70, who claims that he is suffering from multiple ailments, is in prison since April 2020. On November 10, in response to his petition, the Supreme Court allowed him to be put under house arrest for a month and said the order should be implemented within 48 hours. But he is still in prison as formalities of release could not be completed. Mulay, known for her work in films such as "Bhuvan Shome" and "Hu Tu Tu", appeared before the special judge for National Investigation Agency cases Rajesh Kataria, and stated that she was standing as surety for Navlakha. A surety takes responsibility that a person who is going to be released from prison would appear before a court whenever directed. Activist Gautam Navlakha, an accused in the Elgar Parishad-Maoist links case, was on Tuesday brought to a special NIA court in Mumbai hearing the matter pertaining to his release formalities from jail for house arrest. The other accused in the case were also brought to the court from the jail as the case was listed on Tuesday for regular hearing. The Supreme Court had last week allowed Navlakha, lodged at the Taloja Jail in neighbouring Navi Mumbai, to be placed under house arrest for a month owing to his medical condition. The Supreme Court on Thursday allowed jailed activist Gautam Navlakha's request for house arrest, saying prima facie there is no reason to reject his medical report. A bench of Justices K M Joseph and Hrishikesh Roy said the house arrest order should be implemented within 48 hours. The bench also directed Navlakha to deposit Rs 2.4 lakh, an estimated amount which the National Investigation Agency (NIA) claims as expense for making available police personnel. It also said that Navlakha will not be allowed to use a computer and internet during his month-long house arrest.
