SC to pass common order in several nine-judge, seven-judge bench matters

The Supreme Court on Thursday said it will pass a common order in several nine-judge and seven-judge bench matters, including those relating to money bills and the speaker's power to disqualify MLAs, to get them ready for hearing. A seven-judge bench headed by Chief Justice D Y Chandrachud took up six seven-judge and four nine-judges matters for consideration. One of the seven-judge bench matters pertains to the correctness of the 2016 Nabam Rebia verdict relating to the speaker's power on disqualification of MLAs. IRDAI obliged to ensure persons with disability not unduly prejudiced: HC

Taking note of claims of high health insurance premium and loading charges for the specially-abled, the Delhi High Court has said it is the obligation of the sector regulator IRDAI to ensure that such people are not unduly prejudiced. Justice Prathiba M Singh, dealing with a petition for health insurance coverage by a person suffering from Tetraplegia, said the principle of reasonable accommodation mandates that such persons are provided additional support by the society and the State to enable them to lead a life of equal worth and dignity, and that right to life includes the right to avail healthcare, including medical insurance. Following several judicial orders, various general and health insurance companies, including four government insurance companies, have launched products for persons with disabilities, the court noted. 2 judges elevated as HC chief justices; one is due to retire on May 30

Two judges were on Friday elevated as chief justices of high courts with one of them due to retire on May 30. The Department of Justice in the Union Law Ministry issued separate notifications announcing the appointment of acting chief justice of the Bombay High Court Justice Sanjay Vijaykumar Gangapurwala as the chief justice of the Madras High Court and Justice Ramesh Deokinandan Dhanuka as the chief justice of the Bombay High Court. Justice Dhanuka is at present a judge of the Bombay High Court. On Wednesday, Justice S Vaidyanathan was appointed as the acting chief justice of the Madras High Court. Justice T Raja, who was also the acting chief justice of the Madras High Court, had demitted office on Wednesday evening on attaining the age of 62 years. HC allows Sushil Ansal to withdraw suit against web series 'Trial by Fire'

The Delhi High Court Monday permitted real estate tycoon Sushil Ansal, convicted in the 1997 Uphaar cinema fire case, to withdraw a suit seeking to restrain the release of web series "Trial by Fire", which is inspired by the tragedy. The series streamed on Netflix on January 13 as the high court refused to stay its release and dismissed an application for the interim stay. A massive fire had broken out at the Uphaar cinema during the screening of Hindi film 'Border' on June 13, 1997, claiming 59 lives. On Monday, the suit came up before Justice Yashwant Varma who was informed by Ansal's counsel that he wishes to withdraw the suit. The high court allowed the plea for withdrawal. Loan app with Chinese links: Karnataka HC says investigation necessary

Refusing to defreeze the accounts and set aside the show-cause notice issued to a Kerala-based loan app company, the High Court of Karnataka has cautioned against such apps owned by Chinese entities and individuals which are used to destabilise India. In a recent judgment, Justice M Nagaprasanna, while rejecting the petition of Inditrade Fincorp Ltd, registered in Kochi, said, "It is in public domain that several borrowers have committed suicide unable to bear the harassments of the representatives of such loan apps. The office-bearers of several of these companies which control and operate such mobile loan apps are said to be entities of China or individuals from China sitting as directors of such mobile loan apps. Therefore, it becomes necessary for an investigation, in the least to be conducted of any such company who would operate such loan apps and has transactions between each other." SC Collegium recommends 20 additional HC judges for permanent judgeship

The Supreme Court Collegium headed by Chief Justice of India D Y Chandrachud on Wednesday recommended to the Centre the names of 20 additional judges for making them permanent judges in high courts of Allahabad, Mumbai, Madras and Delhi. Of the 20 names, the maximum 10 have been recommended for the Allahabad HC by the three-member Collegium, also comprising justices Sanjay Kishan Kaul and KM Joseph. The Collegiums recommended five for the Madras High Court, four for the Bombay High Court and one for the Delhi High Court. SC to hear plea against appointment of Victoria Gowri as Madras HC judge

The Supreme Court on Monday agreed to hear a plea challenging the appointment of lawyer L Victoria Gowri as a judge of the Madras High Court. A bench comprising Chief Justice DY Chandrachud, and Justices PS Narasimha and JB Pardiwala took note of the submissions of senior advocate Raju Ramachandran that the plea needed urgent hearing. 2022 saw fresh attack on collegium system; record appointments in HCs

Amid a renewed attack mounted by the government on the collegium system of appointing members to the higher judiciary, a "record" 138 judges were appointed to the various high courts this year. Law Minister Kiren Rijiju, who has been questioning the collegium system, dubbed it as being "alien" to the Constitution. He also said that the issue of vacancies and appointments in the higher judiciary would continue to linger till such time a new system is created for the same. Seeking to overturn the collegium system, Parliament had passed - with near unanimity - the National Judicial Appointments Commission Act which was given constitutional status. The government brought into force the Constitution (Ninety-Ninth Amendment) Act, 2014 and the National Judicial Appointments Commission Act, 2014 on April 13, 2015. 153 high court judges appointed this year; more appointments likely: Report

A total of 153 judges have been appointed to the various high courts in this calendar year so far, with sources on Thursday hinting at more appointments to the higher judiciary in the coming days. Six additional judges were appointed to the Bombay High Court on Thursday. It is learnt that the government is also set to take a call on the elevation of Bombay High Court Chief Justice Dipankar Datta to the top court shortly. If he is appointed to the apex court, its working strength will go up to 30. The sanctioned strength of the top court is 34, including the Chief Justice of India (CJI). The government is also set to initiate the process of appointing the next CJI, most likely this week or early next week.
