Copy of Constitution signed by its framers with 22 miniatures authentic: VP

Rajya Sabha Chairman Jagdeep Dhankhar on Tuesday said the signed copy of the Constitution by its framers carrying 22 miniatures is the only authentic copy and can only include amendments by Parliament, and the same should be promulgated in the country. Any violation should be taken seriously by the government and severe action taken, he added. "I have no doubt and I am categorical, the Constitution signed by the founding fathers of the Constitution, carrying 22 miniatures, is the only authentic one and it can include amendments by the Parliament. If there is any change effected by judiciary or any institution, it is not acceptable to this House. "I will appeal to the leader of the House to ensure that in the country, only the authentic version of the Indian Constitution be promulgated. Any violation of this should be taken quite seriously by the government and severe action taken," Chairman Jagdeep Dhankhar said in the House. In a scathing attack on the BJP-led Centre, Congress president Mallikarjun Kharge alleged on Sunday that a hateful agenda, immersed in religious fundamentalism, has sought to divide the society over the last 10 years and every sacred tenet of the Constitution is being "shredded into pieces by an authoritarian regime". A minor's right to obtain a passport and travel abroad cannot be taken away merely due to an ongoing matrimonial dispute between parents, the Bombay High Court has said. The court in its order passed on Wednesday, a copy of which was made available on Thursday, directed the Pune Regional Passport Office (RPO) to issue a passport to the 17-year-old girl within two weeks, observing that the right to travel abroad was a facet of the fundamental right guaranteed in the Constitution. The RPO had issued a communication to the girl's mother in November 2024, stating that her passport application would not be processed as her father had objected to the same. As per the plea, the girl's parents are embroiled in divorce proceedings. In response to the passport office's communication, the girl's mother sent a declaration that the father's consent was missing in the passport issuance form as there was a matrimonial dispute between the couple. Daughter has an indefeasible, legally enforceable and legitimate right to secure educational expenses from her parents, who can be compelled to provide necessary funds within their means, the Supreme Court recently said. The remarks of a bench comprising Justices Surya Kant and Ujjal Bhuyan came in a matrimonial dispute in which the daughter of the estranged couple, who was studying in Ireland, refused to accept Rs 43 lakh given by her father towards her studies as a part of the total alimony being paid to her mother. "She, being the daughter, has an indefeasible, legally enforceable, lawful, and legitimate right to secure educational expenses from her parents. All that we observe is that the daughter has a fundamental right to pursue her education, for which the parents could be compelled to provide necessary funds within the limit of their financial resources," said the bench's January 2 order. The Congress will launch its 'Jai Bapu, Jai Bhim, Jai Samvidhan Abhiyan' in all blocks, districts and states on January 3. The campaign will culminate in a public rally at Mhow on January 26. The campaign was to be launched on December 27 but was suspended in view of the demise of former prime minister Manmohan Singh on December 26 and the announcement of a seven-day mourning in his honour. Delhi HC says endless incarceration without trial violates Article 21

Endless incarceration without trial in near future falls foul of Article 21 of the Constitution, the Delhi High Court said recently and granted bail to a man held in a cheating case in 2022. Justice Amit Mahajan said if an accused was suffering a prolonged incarceration without a timely trial in the case, courts would ordinarily be obligated to release them on bail. Article 21 of the Indian Constitution deals with the right of life and personal liberty. In the case at hand, the judge said charges were yet to be framed, the prosecution had sought repeated adjournments to file a supplementary chargesheet and it had been a year since the accused's last bail plea was dismissed. India must protect the integrity of its constitutional institutions from outside interference, including those that are politically motivated, said Justice P S Narasimha, Judge, Supreme Court of India, on Sunday. Justice Narasimha was delivering the Justice E S Ventakaramiah Centennial Memorial Lecture, organised by the National Law School of India University (NLSIU) in Bengaluru. Justice Venkataramiah served as the 19th Chief Justice of India. He previously served as a judge of the Karnataka High Court, as well as the Advocate General of Mysore.
