HC restrains Income Tax from acting on show cause notice to Kapil Sibal

The Delhi High Court on Thursday restrained the Income Tax Department from proceeding further on the show cause notice issued to Rajya Sabha MP and senior advocate Kapil Sibal in relation to the assessment proceedings pending against him. A bench of Justice Rajiv Shakdher and Justice Tara Vitasta Ganju issued a notice and asked the income tax authorities to file a response on the petition of the former Congress leader. We are of the view that since the impugned notice has been challenged on jurisdiction as well as on the breach of principles of natural justice, it would require some amount of deliberation, the bench said. In the meanwhile, the concerned officer will stay his hands vis--vis the show cause notice of March 11, 2023," it added. The court listed the matter for further hearing on September 14 and asked the officer concerned to first deal with the objections of Sibal. Sibal has challenged the notice issued by the IT department under Section 153C of the Income Tax Act ...

Kapil Sibal announces new platform 'Insaaf' to fight 'injustice' in India

Rajya Sabha leader Kapil Sibal on Saturday announced a new platform to fight "injustice" prevailing in the country under the BJP-led government, calling on everyone, including opposition chief ministers and leaders, to support him in his endeavour. Addressing a press conference here, Sibal said he was launching the platform "Insaaf" and a website "Insaaf ke sipahi" to help people rise in the fight against injustice with lawyers at the forefront of the initiative. Rajya Sabha MP Kapil Sibal on Tuesday took a swipe at Law Minister Kiren Rijiju over his remarks that the government has not taken a single step to undermine the judiciary, asking whether his "controversial statements" were meant to strengthen it. Sibal's remarks come a day after Rijiju said there can be a difference of opinion between the government and the judiciary but that does not mean the two are attacking each other and a "Mahabharat" is going on. Rajya Sabha MP Kapil Sibal on Friday attacked the government over a Supreme Court-appointed committee's observation that the Centre did not cooperate with the Pegasus probe, saying "non-cooperation" is often an evidence of guilt. The apex court on Thursday said the technical panel appointed by it to probe the unauthorised use of Pegasus has found some malware in five of the 29 mobile phones examined, but could not conclude whether it was due to the Israeli spyware. After perusing the report submitted by former Supreme Court Justice R V Raveendran, Chief Justice N V Ramana also noted that the central government did not cooperate with the probe.
