Describing as a "worrisome trend" the "rising" cases of fraudulent marriages between NRIs and Indian citizens, the Law Commission has recommended a comprehensive law to deal with the situation and compulsory registration of such alliances. While presenting the report "Law on Matrimonial Issues Relating to Non-Resident Indians and Overseas Citizens of India" to the law ministry, panel chairman Justice (Retd) Ritu Raj Awasthi said the Commission is of the opinion that the proposed central legislation should be comprehensive enough to cater to all facets involving marriages of NRIs as well as foreign citizens of Indian origin with that of Indian citizens. An expert committee headed by former law secretary T K Vishwanathan has submitted its report on reforms in the arbitration sector to the law ministry, sources said on Wednesday. The panel, which also had representatives of the law ministry as well as domain experts, has recommended an amendment to the Arbitration law to confer on the court the power to set aside or vary the arbitration award, the sources said. Industry representatives have dubbed the proposed changes in the law as a setback for arbitration reforms in the country. They said that one of the major issues plaguing arbitrations especially in a jurisdiction such as India is with regard to the fees charged by arbitrators being on the higher side. The reforms propose deletion of the Fourth schedule dealing with fee schedule. The panel has also set no limits on number of arbitrations an arbitrator can take, leading to delay in award, they said. The Law Commission will share next week its roadmap on holding simultaneous polls with the high-level committee headed by former president Ram Nath Kovind. The panel has invited the Law Commission on October 25 to seek its views on how simultaneous polls can be held in the country. The high-level panel, which had in its first meeting recently decided to seek views of political parties, has now written to them to elicit their views on holding sustainable simultaneous polls in the country. In a communication to the parties, it has sought an interaction with with them on a "mutually agreed date", sources said citing the letter. They said parties have also been given an option to send their views in writing in the next three months. The Law Commission has recommended rolling out registration of e-FIRs in a phased manner beginning with offences bearing up to three years jail term. In a report submitted to the government earlier this week and made public on Friday, the law panel proposed setting up a centralised national portal to facilitate registration of e-FIRs. It said e-FIRs will tackle long persisting issue of delay in the registration of FIRs and allow citizens to report crimes in real time. In his letter to Law Minister Arjun Ram Meghwal, Law Commission Chairman Justice Ritu Raj Awasthi said, "Due to the march of technology, means of communication have progressed in leaps and bounds. In such a landscape, clinging on to an archaic system of registering FIRs does not augur well for criminal reforms.
