SC seeks LS secretary general's reply on Moitra's plea against expulsion

The Supreme Court on Wednesday sought a reply from the Lok Sabha secretary general on Trinamool Congress leader Mahua Moitra's plea challenging her expulsion from the Lower House. A bench of Justices Sanjiv Khanna and Dipankar Datta refused to pass any order on an interim prayer of Moitra to let her attend the proceedings of the House, saying, allowing it would be like allowing the main petition. "We will consider your plea for interim relief in March," Justice Khanna told Senior advocate Abhishek Singhvi, appearing for Moitra. The top court also refused to issue any notice to Lok Sabha Speaker Om Birla and the Committee on Ethics of Lok Sabha -- both were made a party by Moitra in her plea -- and said it would only seek a reply from the Lok Sabha secretary general. Solicitor General Tushar Mehta, appearing for the Lok Sabha secretary general, requested the court not to issue a formal notice and said that he would file a reply to Moitra's petition. Mehta said the court should not

Parl security breach: HC to hear plea on supply of FIR copy to accused

The Delhi High Court on Friday agreed to list for hearing during the day a plea by the city police challenging a trial court order directing it to supply a copy of the FIR to an accused in the Parliament security breach case. The matter was mentioned for hearing before a bench of Acting Chief Justice Manmohan and Justice Mini Pushkarna by the counsel for the police. "We arrested four accused persons. In sensitive matters where we don't provide a copy of the FIR, they have to approach the commissioner. (Trial court), however, directed that we supply a copy," the lawyer said. "List it today if in order," Justice Manmohan said. On Thursday, Special Judge Hardeep Kaur extended till January 5 the custody of four accused -- Manoranjan D, Sagar Sharma, Amol Dhanraj Shinde and Neelam Devi -- arrested in the Parliament security breach case. On an application by Neelam, the trial court also directed the Investigating Officer (IO) to hand over a copy of the FIR to her counsel. "The concerne

Parliament passes Bill for CEC, EC appointments, Meghwal critiques old law

The Lok Sabha on Thursday passed after a brief discussion a Bill which seeks to establish a mechanism to appoint the chief election commissioner and election commissioners. The Rajya Sabha has already given its nod to the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Bill, 2023. Responding to the debate, Law Minister Arjun Ram Meghwal said the 1991 Act on the service conditions of the CEC and the ECs was a half-baked attempt and the present Bill covers the areas left out by the previous legislations. The Bill was then passed by a voice vote.

Ten states withdraw general consent to CBI to investigate cases: Centre

Ten states, including Tamil Nadu and Telangana, have withdrawn general consent to the CBI to investigate cases in their respective jurisdictions, the Lok Sabha was informed on Wednesday. According to section 6 of the Delhi Special Police Establishment (DSPE) Act, 1946, the Central Bureau of Investigation (CBI) needs consent from the respective state governments to conduct investigations in their jurisdiction. Punjab, Jharkhand, Kerala, Rajasthan, Chhattisgarh, West Bengal, Mizoram, Telangana, Meghalaya, and Tamil Nadu have withdrawn the general consent, Minister of State for Personnel Jitendra Singh said in a written reply. To a question, whether the Union government proposed to amend section 6 of the DSPE Act, the minister said, "No". Asserting that withdrawal of general consent by some states has led to severe limitations in the CBI's powers to investigate crucial cases, a Parliamentary panel had recently said there was a dire need to enact a new law and give wider powers to the
