SC imposes interim stay on HC order on UP Board of Madarsa Education Act

The Supreme Court on Friday imposed an interim stay on an order of the Allahabad High Court that declared the Uttar Pradesh Board of Madarsa Education Act, 2004, "unconstitutional" and violative of the principle of secularism. A three-judge bench headed by Chief Justice D Y Chandrachud issued notices to the Centre, Uttar Pradesh government and others on the pleas against the high court order. "The object and purpose of Madarsa board is regulatory in nature and the Allahabad HC is not prima facie correct that establishment of board will breach secularism," the bench, also comprising Justices J B Pardiwala and Manoj Misra, said. The top court said HC has misconstrued provisions of the 2004 act as it does not provide for religious instruction and the purpose and character of the statute is regulatory in nature. Curfew relaxed in Haldwani's Banbhoolpura after 7 days following violence

The administration announced curfew relaxation for a few hours in the Banbhoolpura town on Thursday, seven days after it was imposed following the violence over the demolition of an "illegal" madrasa. According to an order issued by Nainital District Magistrate Vandana Singh the curfew will be relaxed from 9 am to 4 pm in Gaujajali, Railway Bazar and FCI godown area. In the rest of Banbhoolpura, it will be relaxed for two hours from 9 am to 11 am. Violence broke out on February 8 over the demolition of an illegally built madrassa in the Banbhoolpura area, with locals hurling stones and petrol bombs at municipal workers and police, forcing many police personnel to seek refuge at a police station, which the mob then set on fire. UP Madarsa Education Board member protests Friday offs in 2023 calender

A member of the Uttar Pradesh Madarsa Education Board has protested the release of the annual calendar for next year that marks Fridays as weekly-offs in Islamic seminaries ignoring a proposal to shift it to Sunday like other state schools. Board member Qamar Ali, who had proposed Sunday holidays in madrasas in the state, said on Monday said he would complain to Chief Minister Yogi Adityanath about the calendar being issued without any discussion in the board. Ali had placed his proposal in the board meeting on December 20 and it was expected to be taken up for discussion in the next meeting. Speaking to PTI, Ali accused board chairman Iftikhar Ahmad Javed of releasing the calendar for 2023 on December 24 without consulting other members.
