Lawmakers in Thailand's lower house of Parliament overwhelmingly approved a marriage equality bill on Wednesday that would make the country the first in Southeast Asia to legalise equal rights for marriage partners of any gender. The bill passed its final reading with the approval of 400 of the 415 members of the House of Representatives who were in attendance, with 10 voting against it, two abstaining and three not voting. The bill amends the Civil and Commercial Code to change the words men and women and husband and wife to individuals and marriage partners. It would open up access to full legal, financial and medical rights for LGBTQ+ couples. The bill now goes to the Senate, which rarely rejects any legislation that passes the lower house, and then to the king for royal endorsement. The opposition Congress and AIUDF staged walkouts from the Assam Assembly on Monday, protesting the decision by the state Cabinet to repeal the Assam Muslim Marriages and Divorces Registration Act, 1935. The AIUDF had moved an adjournment motion to discuss the cabinet decision, which was rejected by Speaker Biswajit Daimary. The Congress maintained that amendments could have been made to the original bill without repealing it altogether. The Assam Cabinet on Friday had approved the decision to repeal the Act in a bid to end the social menace of child marriage in the state, Chief Minister Himanta Biswa Sarma said. Responding to the opposition parties' criticism, Sarma asserted in the House on Monday that the bill will be repealed as it is a step towards abolishing child marriage. A voidable marriage is one that can be rendered invalid by the husband or wife through a decree, while a void marriage is invalid at the very inception. A bench of Justices BV Nagarathna and Augustine George Masih sought to know the existing law which gives legitimacy to children born outside marriage while hearing a batch of pleas challenging various provisions and rules of Surrogacy (regulations) Rules, 2022 and Assisted Reproductive Technology (Regulations) (ART) Act of 2021. The bench disposed of a number of petitions in view of the Centre's February 21 notification amending the Surrogacy Rules 2022 and allowing married couples to use an egg or sperm of a donor in case one of the partners is suffering from a medical condition. Describing as a "worrisome trend" the "rising" cases of fraudulent marriages between NRIs and Indian citizens, the Law Commission has recommended a comprehensive law to deal with the situation and compulsory registration of such alliances. While presenting the report "Law on Matrimonial Issues Relating to Non-Resident Indians and Overseas Citizens of India" to the law ministry, panel chairman Justice (Retd) Ritu Raj Awasthi said the Commission is of the opinion that the proposed central legislation should be comprehensive enough to cater to all facets involving marriages of NRIs as well as foreign citizens of Indian origin with that of Indian citizens.
