Ordinance on services matter was brought as money power: Kejriwal

Chief Minister Arvind Kejriwal on Friday attacked the BJP-led Centre, saying the ordinance on services matter was brought as money power and the threat of the ED and the CBI failed in Delhi. In a speech in the Assembly, he also claimed that the BJP has brought the "Sanghi" model of democracy through the Services Bill while asserting that the 2024 Lok Sabha elections will be fought on the issue of full statehood for the national capital. Kejriwal alleged that the "democratic rights of the people of Delhi were trampled through the ordinance and the bill". "There are several styles of democratic systems like the Westminister style and parliamentary style. These people (BJP) have brought the Sanghi style of democracy through this bill," he said. "The ordinance on services matter was brought because money power and the threat of the ED and the CBI had failed in Delhi," he added. Kejriwal also claimed that recently, someone from BJP had threatened him, saying, "We will make you bow ...

People of Delhi will give befitting reply to BJP in elections: AAP

The AAP on Tuesday targeted the Centre over the Delhi services bill passed by Parliament and said the people of the national capital will give a "befitting reply" to the BJP in the upcoming elections. AAP chief national spokesperson Priyanka Kakkar said the entire opposition "unitedly opposed" the bill. Party Delhi convener Gopal Rai said the bill is an "insult" to the people of Delhi. "The entire opposition unitedly opposed the unconstitutional bill yesterday. We are fighting the battle in Parliament and the court. The people of Delhi will give them (BJP) a befitting reply in the next elections," Kakkar told PTI. Parliament on Monday passed the Government of National Capital Territory of Delhi (Amendment) Bill, 2023, that gives the central government control over bureaucrats in the Delhi government. Rai alleged that the bill was introduced in Parliament by the Central Government against the decision of the Supreme Court and called it a "murder of democracy". "The bill brought in

Delhi Services Bill passed, another round of tussle between AAP, L-G likely

The Delhi services bill, passed in Rajya Sabha on Monday, is likely to set the stage for another round of confrontation between the AAP dispensation and the Lt Governor, even as the legislation puts the seal on the Centre's primacy on the control of the city government's bureaucracy. The Government of National Capital Territory of Delhi (Amendment) Bill, 2023, was passed with the Upper House of Parliament approving it with 131 votes in favour and 102 against. Union Home Minister Amit Shah introduced the contentious bill in the House and said that the proposed legislation is aimed at providing effective and corruption-free governance in the national capital. The bill, which was passed by the Lok Sabha last week, replaces an ordinance promulgated by the Centre for handling the transfers and postings of officials in the Delhi government. However, the matter is still hanging fire as the Supreme Court last month formed a constitution bench to examine the power of Parliament over governa

No-trust vote, Delhi services Bill highlight of final week of Parliament

The Monsoon session of Parliament is set for a stormy final week with the Lok Sabha being set to take up the no-confidence motion against the government while the Rajya Sabha is likely to witness some spirited debate over the Delhi services bill. At the outset, all eyes will be on the Lok Sabha Secretariat on Monday when it is expected to review the stay granted by the Supreme Court on the conviction of Rahul Gandhi in the 'Modi surname' case and decide on the revocation of his Parliament membership. If Gandhi's disqualification is revoked, the Congress would prefer him to be the key speaker from the opposition ranks during the no-trust motion which is scheduled to be taken up for debate on Tuesday. The Rajya Sabha will take up the Delhi services bill on Monday. The Business Advisory Committee of the Lok Sabha has allotted 12 hours for the discussion on the no-trust motion and Prime Minister Narendra Modi is expected to respond to the debate on Thursday. Stage set for stormy week as parliament set to take up Delhi services bill

The Monsoon session of Parliament which saw many disruptions since it began on July 20 over the Manipur violence issue, is set to become more turbulent with the government likely to introduce a bill in the Lok Sabha to replace the Delhi services ordinance. The Congress and other opposition parties have also come out against the ordinance. The government has also listed 13 draft legislations for consideration and passing in the Lok Sabha even as a notice for moving a no-confidence motion is pending before the House. Will examine if Parl can abrogate constitutional principles for Delhi: SC

The Supreme Court has said a five-judge constitution bench will examine the "contours of the power" of Parliament to make law for Delhi and also if it can "abrogate the constitutional principles of governance" for the city dispensation by making a law to take away its control over services. Eight days after a constitution bench held that the Delhi government will have control over services, the Centre on May 19 promulgated an ordinance on the Delhi services matter by exercising its powers under Article 239-AA, a special provision in the Constitution pertaining to the national capital. The top court, which on Thursday referred to a constitution bench the Delhi government's plea challenging the ordinance, framed two legal questions in its 10-page order to be dealt by a larger bench on the ordinance which set off a fresh tussle between the two power centres. "We accordingly refer the following questions to a constitution bench: (i) What are the contours of the power of Parliament to ..

Row over services: HC refuses to entertain plea against Centre's ordinance

The Delhi High Court Thursday refused to entertain a plea challenging the Government of National Capital Territory of Delhi (Amendment) Ordinance, 2023, promulgated by the Central Government. A bench of Chief Justice Satish Chandra Sharma and Justice Sanjeev Narula noted that the issue of challenging the constitutional validity of the ordinance is already pending before the Supreme Court and granted liberty to the petitioner to approach the apex court. Ordinance promulgated as officers targeted by Delhi govt: Centre to SC

The Centre on Monday told the Supreme Court that the ordinance on control of services in Delhi was promulgated as officers working in the vigilance department were "targeted" by the city government, and bureaucrats and officials were humiliated. In an affidavit filed in the apex court, the Centre claimed that after the May 11 judgement of the constitution bench of the top court, ministers in the Delhi government started a "witch-hunt" and harassment of officers to influence their decision making. A five-judge constitution bench of the apex court had on May 11 said the Delhi government has legislative and executive powers over administration of services except for public order, police and land. "To elaborate the above, the officers working in the vigilance department, that is the department which handles serious vigilance issues relating to complaints of corruption, thus involving, criminal and other politically sensitive cases, came to be specifically targeted by the elected ...

SC issues notice to Centre on plea filed by Delhi govt against Ordinance

The Supreme Court on Monday sought the Centre's stand on a plea filed by the Delhi government challenging the constitutionality of the ordinance on control of services. A bench comprising Chief Justice D Y Chandrachud and Justices P S Narasimha issued notice to the government and asked senior advocate Abhishek Singhvi, appearing for the AAP government, to amend its plea and add the Lieutenant Governor as party in case. "We'll issue notice," the bench said while posting the matter for hearing on July 17. In its plea, the AAP government has said it is an "unconstitutional exercise of executive fiat" that attempts to "override" the top court and the basic structure of the Constitution. Besides quashing the ordinance, the Delhi government has also sought an interim stay on it. The Centre had on May 19 promulgated the Government of National Capital Territory of Delhi (Amendment) Ordinance, 2023, to create an authority for transfer and posting of Group-A officers in Delhi. Oppn meet attendees disagree with AAP's charge against Cong on ordinance

The Aam Aadmi Party's shrill indictment of the Congress over alleged apathy towards the central ordinance issue seemed to have few takers among those present at the recent opposition meeting in Patna. At least five leaders, who represented their respective parties at Friday's meeting hosted by Bihar Chief Minister Nitish Kumar, appeared unimpressed with the AAP going into a sulk over the ordinance, which seeks to curtail the powers of the Delhi government. It is very unfortunate that the AAP seems to be looking at the issue through the prism of rivalry with Congress in Delhi and Punjab, said CPI(ML) Liberation general secretary Dipankar. He asserted that it was wrong on AAP's part to say in an official statement that the Congress refused to oppose the ordinance at the meeting, despite being asked to do so by many parties. All parties were unanimous in the condemnation of the ordinance. But the AAP leadership must place the issue in a broader context. It is about the attacks on the
