Flare-ups in HP reveal Cong not immune to communalism: Prashant Bhushan

Sectarian flare-ups in Himachal Pradesh is a proof that Congress is not immune to communal politics, senior advocate Prashant Bhushan said on Tuesday. The northern hill state is afflicted with Hindu-Muslim confrontations for over a month, ostensibly over a mosque in Sanjauli near Shimla which some partisan groups are demanding must be demolished. "The way this incident happened and spread to other parts of Himachal shows that due to the work done by the Hindutva organisations, communal poison has spread. So they could mobilise people. "It also shows that even Congress is not immune to this disease," Bhushan said at the launch of a fact-finding report which carried its investigations from HP. "Even Congress has people who are opportunistically communal, even if they do not have a communal ideology. They feel they can use communalisation for gaining votes," he said, terming the trend dangerous. He said that while Rahul Gandhi did Bharat Jodo Yatra, some leaders of his party were not

SC rejects PIL asking to halt export of arms, military equipments to Israel

The Supreme Court on Monday dismissed a PIL seeking a direction to the Centre to stop the export of arms and military equipments to Israel which is fighting a war in Gaza, saying the court cannot enter into the domain of the nation's foreign policy. A bench comprising Chief Justice D Y Chandrachud and Justices JB Pardiwala and Manoj Misra said the Indian firms, involved in the export of arms, equipments to Israel, may be sued for breach of contractual obligations and hence they cannot be stopped from supplying. "We cannot enter into the nation's foreign policy domain," the bench said. "Can we direct that under the UN's genocide convention you ban the export to Israel...why this restraint. This is because it impacts the foreign policy and we do not know what the impact will be," the CJI said. A PIL was filed by Ashok Kumar Sharma and others through lawyer Prashant Bhushan seeking a direction to the Centre to cancel licences and not to grant new ones to Indian firms exporting arms an

Electoral bonds used as bribe by companies for contracts: Prashant Bhushan

Lawyer Prashant Bhushan on Saturday labelled the electoral bonds as the biggest scam in the history of Indian democracy and alleged that they were used as bribes for contracts, shielding people from central probe agencies, manipulating policies, and influencing drug regulators. He said the Supreme Court will soon commence hearing on a petition filed before it seeking a probe by a Special Investigation Team (SIT) into alleged quid pro quo arrangements between corporates and political parties. "The electoral bonds were used (by companies) as bribes to get contracts, to protect themselves from the Enforcement Directorate (ED) and the CBI and to save themselves from drug regulators," Bhushan said. Out of the Rs 16,500-crore electoral bonds, half went to the BJP and the rest to parties like the TMC and the Congress. However, those who were not ruling did not get any money, he said. "I see that Rs 5,000-crore worth of electoral bonds were issued, resulting in the sanctioning of contracts

One nation one election aims to postpone polls in 5 states: Bhushan

Renowned Supreme Court lawyer and activist Prashant Bhushan alleged that the central government has been campaigning for the 'one nation one election' (ONOE) only to postpone upcoming assembly elections in five states. The assembly polls in Madhya Pradesh, Rajasthan, Chhattisgarh, Telangana and Mizoram are due later this year. "ONOE cannot be implemented in a Parliamentary democracy like India because in our system a government can fall in midterm when it loses majority and a fresh government forms," Bhushan told reporters here on Sunday. However, if the one nation one election will be implemented, in such a situation, Presidential rule will be imposed, which is against democracy, he claimed. "That means we are switching from democratic system to a presidential rule system. So it will be a total violation of parliamentary democracy. In my view, the government clearly knew about this and they also know that several amendments in the constitution are required to switch to the ...
