Insurance claims independent of human errors, say industry players

The death of former Tata group chairman Cyrus Mistry in a road accident has ignited a debate over the eligibility of insurance claims in accident cases but industry players say the very purpose of buying insurance is to hedge against risk, whether due to human error or otherwise. Human error or violation of rules is unlikely to vitiate an insurance policy and accidental death claims will continue to be honoured albeit in exceptional cases the compensation amount may be lowered. Insurance documents per se do not list out acts, such as not wearing a seat belt, that could impact payment of compensation in case of death of occupants other than the driver, they said. However, most policies mention "any accidental loss or damage suffered whilst the insured or any person driving the vehicle with the knowledge and consent of the insured is under the influence of intoxicating liquor or drugs", the compensation amount may be limited and would vary from car make and the kind of policy taken.

Cyrus Mistry cremated in Mumbai; Ratan Tata's stepmother attends funeral

Cyrus Mistry, the former Tata Sons chairman who was killed in a road accident earlier this week, was cremated in the financial capital on Tuesday. The funeral at central Mumbai's Worli crematorium was attended by members of the closely knit Parsi community, some business leaders and politicians. Industry doyen Ratan Tata's stepmother Simone Tata was also present. Wheelchair-bound Simone Tata, 92, arrived at the crematorium in a special van. Cyrus Mistry's last rites to be performed in Mumbai at 11 am on Tuesday

Business tycoon and former chairman of Tata Sons Cyrus Pallonji Mistry, who died in a road accident near Mumbai, will be cremated here on Tuesday morning, said a family member on Monday. The last rites of Mistry (54), who was killed in the road accident on Sunday, will be performed at Worli crematorium. Some family members are arriving in Mumbai by tonight (Monday night). Mistry's body will be taken to Worli crematorium tomorrow and will be cremated at 11 am, the family member said. The well-known businessman and his friend Jahangir Pandole died when their speeding car hit a divider on a bridge on the Surya river on the Mumbai Ahmedabad National Highway in adjoining Palghar district. 8 killed as car falls into gorge in J&K's Kishtwar; LG expresses grief

Eight people, including a 16-year-old girl, were killed and three others sustained serious injuries when the car in which they were travelling skidded off the road and plunged into a 300-feet gorge in Kishtwar district of Jammu and Kashmir on Tuesday, officials said. The vehicle was on its way from Chingam to Chatroo and the accident occurred around 3.15 pm near Bonda village. All the passengers who died belonged to Bonda village, officials said. They said, rescue teams, comprising police, and Rashtriya Rifles personnel and local villagers, carried out the rescue operation. Five people were found dead on the spot and three others succumbed to injuries while being taken to a hospital, officials said, adding three more injured were hospitalised in a critical condition. Over two dozen people sustain injuries in truck accident in UP's Gonda

Over two dozen people got injured here on Friday evening, when a truck in which they were travelling fell into a gorge, officials said. Additional Chief Medical Officer Dr TP Jaiswal said all injured have been hospitalised. Police sources said that the injured were returning from a cremation in a truck. At around 10.00 pm on the Gonda-Balrampur road, the driver of the DCM truck lost control over it while trying to avoid hitting a stray animal, and drove the truck into a gorge, police said.

At least 9 killed, 13 injured as tempo-lorry collides in Karnataka

At least 9 people were killed and 13 others injured in a road accident near Kalambella here during early Thursday morning, Police sources said. The incident happened when a tempo collided with a lorry. The deceased are said to be daily wage workers from various parts of Raichur district and were on their way to Bengaluru, sources said. The injured have been shifted to hospital for treatment. The Tempo Trax (a multi-utility vehicle) in which the victims were travelling was said to be crowded with nearly 24 passengers, sources said, adding that the deceased include a couple of children. Ford Motor Co. plans to appeal a USD 1.7 billion verdict against the automaker after a pickup truck crash that claimed the lives of a Georgia couple, a company representative said on Sunday. Jurors in Gwinnett County, just northeast of Atlanta, returned the verdict late last week in the yearslong civil case involving what the plaintiffs' lawyers called dangerously defective roofs on Ford pickup trucks, lawyer James Butler Jr. said on Sunday. Melvin and Voncile Hill were killed in April 2014 in the rollover wreck of their 2002 Ford F-250. Their children Kim and Adam Hill were the plaintiffs in the wrongful death case. DMU train hits truck at railway crossing in Hoshiarpur; driver escapes

A truck driver had a narrow escape when a DMU train bound for Jalandhar from Hoshiarpur hit the vehicle at a railway crossing in village Mandiala, about 16 kilometers from here, police said on Saturday. The incident took place on Friday night when the truck carrying LPG gas cylinders was going from Jalandhar to the bottling plant near Mandiala village, they said. When it reached the railway crossing gate, the diesel multiple unit (DMU) train coming from Hoshiarpur side hit the rear side of the truck and also dragged it for some distance, police said. Station Superintendent, Nasrala Railway Station, Mohan Singh said the DMU train remained stranded for around three hours at the accident site. However, no loss of life was reported. The railway staff brought a crane to the accident site and the truck was towed to the side. Thereafter, the rail traffic resumed. A case under relevant sections of the Railways Act has been registered against the gateman on duty in this regard.

Rajasthan: Six killed, 20 hurt in Pali road accident; PM expresses grief

Six people were killed and over 20 injured in a road accident in Rajasthan's Pali district on Friday night, police said. Sumerpur police station incharge Rameshwar Bhati said a tractor-trailer carrying pilgrims and a truck collided in the district. The pilgrims were returning from Jaisalmer's Ramdevra, where a temple of folk deity Baba Ramdev is located. He said six people died in the accident while more than 20 were injured. The injured have been admitted to a nearby hospital. The Prime Minister's Office in a tweet said PM Narendra Modi expressed grief over the incident. "The accident in Pali, Rajasthan is saddening. In this hour of grief, my thoughts are with the bereaved families. I pray for a speedy recovery of those injured," the PM said.
