Weinstein scheduled to appear in NYC courtroom for upcoming retrial heaing

Harvey Weinstein is scheduled to appear in a New York court Friday ahead of a planned retrial on rape and sexual assault charges. The former Hollywood movie mogul's pretrial hearing in Manhattan criminal court will address issues related to evidence in the case, including text messages. At a hearing last week, prosecutors said they anticipate a November retrial. They told Judge Curtis Farber they are still actively pursuing new claims against Weinstein, though the prosecutors conceded they hadn't yet brought any findings to a grand jury. Weinstein's lawyer, Arthur Aidala, argued the investigation was simply a delay tactic. New York's highest court threw out Weinstein's 2020 conviction earlier this year, ruling that the original trial judge unfairly allowed testimony against him based on allegations that weren't part of the case. The conviction had been considered a landmark in the #MeToo movement, an era that began in 2017 amid numerous allegations of sexual misconduct against the

Fresh protests rock trouble-torn Sandeshkhali, DGP rushes to the spot

As fresh protests rocked parts of trouble-torn Sandeshkhali in West Bengal's North 24 Parganas district on Friday morning, West Bengal DGP Rajeev Kumar rushed to the spot and pledged stern action against the culprits. On Friday morning, enraged locals set fire to properties belonging to TMC leaders accused of sexual abuse of women and forcible land grabbing in the area. The houses of local TMC leaders were also ransacked by the mob. Armed with sticks, they set ablaze thatched structures near a fishing yard in Belmajur area of Sandeshkhali, venting their fury against the elusive TMC leader Shahjahan Sheikh and his brother Siraj. The torched structure, it was revealed, belonged to Siraj. "The police for years did nothing. That is why we are doing everything to get back our land and honour", a protester said. The police later entered the area and tried to pacify the protesters. In the afternoon, Kumar rushed to the troubled riverine area and spoke to the locals. "You register your .

Trump may testify in Carroll sex abuse trial, court limits what he can say

Former President Donald Trump has told the public for years what he thinks of E. Jean Carroll, the writer who claims he sexually assaulted her in the 1990s. Now he has a chance to talk to a jury about her but within limits he might well test. Trump could testify as soon as Monday in the defamation trial over his 2019 comments branding Carroll a liar who faked a sexual attack to sell a memoir. He plans to be in court as the New York trial resumes after a weekend break. Because a different jury found last year that Trump sexually abused Carroll, US District Judge Judge Lewis A. Kaplan has ruled that if the former president takes the stand now, he won't be allowed to say she concocted her allegation or that she was motivated by financial or political considerations. But even while just watching the proceedings, the voluble ex-president and current Republican front-runner hasn't checked his contempt for the case. While Carroll testified last week, he complained to his lawyers about a

Harassment case: Brij Bhushan claims contradiction in witnesses' account

Former Wrestling Federation of India chief and BJP MP Brij Bhushan Sharan Singh Saturday urged a Delhi court to discharge him in a sexual harassment case lodged by six female wrestlers, claiming contradictions in the statements of prosecution witnesses. Represented by advocate Rajeev Mohan, the accused also claimed that as per the law, the oversight committee formed to look into the case had to recommend the registration of FIR within seven days. But "since in the matter at hand, no such recommendation has been made , it is safe to assume that the Oversight Committee did not find a prima facie case against accused", he said. The judge, meanwhile, granted exemption from personal appearance for the day to Singh on an application moved by his lawyer. "Since no prima facie case was found out by the Oversight Committee, and since no case was found out, no FIR was registered, and since no FIR was registered, it automatically amounts to exoneration," the counsel told the court. Not advisable to tinker with age of consent under POCSO Act: Law Commission

The Law Commission has advised the government not to tinker with the existing age of consent under the POCSO Act and suggested introducing guided judicial discretion in the matter of sentencing in cases involving tacit approval of children in the 16-18 age bracket. The Law Commission has submitted its report on the age of consent under the Protection of Children from Sexual Offences (POCSO) Act to the Law Ministry in which it has suggested that amendments are needed in the legislation to remedy the situation in cases involving tacit approval, though not consent in law, on the part of children aged between 16 and 18. The current age of consent in India is 18. The panel said that reducing the age of consent will have direct and negative bearing on the fight against child marriage and child trafficking and also advised courts to tread with caution even in cases where it is observed that adolescent love cannot be controlled and criminal intention may be missing.
