NY fraud penalty: Donald Trump posts $175 mn bond to avert asset seizure

Donald Trump has posted a USD175 million bond in his New York civil fraud case, halting collection of the more than USD454 million he owes and preventing the state from seizing his assets to satisfy the debt while he appeals, according to a court filing. A New York appellate court had given the former president 10 days to put up the money after a panel of judges agreed last month to slash the amount needed to stop the clock on enforcement. The bond Trump is posting with the court now is essentially a placeholder, meant to guarantee payment if the judgment is upheld. If that happens, the presumptive Republican presidential nominee will have to pay the state the whole sum, which grows with daily interest. If Trump wins, he won't have to pay the state anything and will get back the money he has put up now. Until the appeals court intervened to lower the required bond, New York Attorney General Letitia James had been poised to initiate efforts to collect the judgment, possibly by seizi

Trump's classified documents case mired in delays may run past US elections

The case against Donald Trump seemed relatively straightforward in August 2022 when FBI agents searched his Mar-a-Lago estate, with authorities citing evidence that the former president hoarded enough classified documents to fill dozens of boxes and obstructed the government's efforts to retrieve them. But nine months after he was indicted, there are mounting doubts that the case can reach trial this year. The Trump-appointed judge in the case has yet to set a firm trial date despite holding two hours-long hearings with lawyers this month. Multiple motions to dismiss the case are still pending, disputes over classified evidence have spanned months and a bitterly contested defense request to disclose the names of government witnesses remains unresolved. Complicating matters further is a recent order suggesting that the judge, Aileen Cannon, is still entertaining a Trump team claim about his rightful possession of the documents that she had appeared openly skeptical of days ...

Trump avoids corporate death penalty in fraud case, his biz to get slammed

Donald Trump won't face the corporate death penalty after all. A New York judge on Friday spared the ex-president that worst case punishment as he ruled in a civil case alleging Trump fraudulently misrepresented financial figures to get cheaper loans and other benefits. Still, Trump got slammed hard, facing big cash penalties, outside supervision of his companies and restrictions on his borrowing. In a pretrial ruling last year, the same judge threatened to shut down much of the Republican presidential front-runner's business by calling for the dissolution of corporate entities that hold many of his marquee properties. That raised the specter of possible fire sales of Trump Tower, a Wall Street skyscraper and other properties. But New York Supreme Court Judge Arthur Engoron called off the dissolution. Instead, he said the court would appoint two monitors to oversee the Trump Organization to make sure it doesn't continue to submit false figures. It's a complete reversal, said real

Ex-Trump CFO faces possible perjury charge over civil fraud trial testimony

Manhattan prosecutors are weighing a potential perjury charge against Donald Trump's former corporate finance chief in connection with testimony he gave in October at the ex-president's New York civil fraud trial, two people familiar with the matter told the Associated Press. Allen Weisselberg, who had been the longtime chief financial officer of the Trump Organization, testified for two days at the trial, answering questions about allegations that Trump lied about his wealth on financial statements given to banks and insurance companies. It wasn't clear what part of Weisselberg's testimony drew the scrutiny of prosecutors in the office of Manhattan District Attorney Alvin Bragg. A decision on charging Weisselberg didn't appear imminent. Bragg's office was in the preliminary stages of discussions, internally and with Weisselberg's legal team, the people said. They may not necessarily lead to a criminal charge. The people were not authorized to speak publicly and did so on condition

Trump plans to deliver a closing argument at his civil fraud trial: Reports

Former President Donald Trump aims to deliver his own closing argument Thursday in his New York civil business fraud trial in addition to his legal team's summations, according to two people familiar with the highly unusual plan. Trump is a defendant in the case brought by New York Attorney General Letitia James. She claims his net worth was inflated by billions of dollars on financial statements that helped him secure business loans and insurance. An attorney for Trump informed Judge Arthur Engoron earlier this week that the former president wished to speak during the closing arguments, and the judge approved the plan, according to one of the two people who spoke to The Associated Press. Both persons who confirmed the plan did so on condition of anonymity because they weren't authorized to disclose the information to reporters. The Trump campaign and a spokesperson for James declined to comment. The former president and current Republican front-runner denies any wrongdoing, and he

Trump Jr. returning to stand as defence looks to undercut fraud claims

Foiled in their longshot bid for an early verdict, Donald Trump's lawyers will start calling witnesses of their own Monday in the New York civil fraud trial that threatens the former president's real estate empire. First up: Donald Trump Jr., who'll be returning to the witness stand two weeks after state lawyers quizzed him during a major stretch of the trial that also featured testimony from his father and siblings Eric and Ivanka Trump. Trump's oldest son, a Trump Organization executive vice president, originally testified on November 1 and 2. He said he never worked on the annual financial statements at the heart of New York Attorney General Letitia James' lawsuit. He said he relied on the company's longtime finance chief and outside accounts to verify their accuracy. James alleges Donald Trump, his company and executives including Eric and Donald Jr. exaggerated his wealth by billions of dollars on financial statements given to banks, insurers and others. The documents were used

Trump Org convicted in executive tax dodge scheme, 2 entities guilty

Donald Trump's company was convicted of tax fraud on Tuesday in a case brought by the Manhattan District Attorney, a significant repudiation of financial practices at the former president's business. A jury found two corporate entities at the Trump Organization guilty on all 17 counts, including conspiracy charges and falsifying business records. The verdict came on the second day of deliberations following a trial in which the Trump Organization was accused of being complicit in a scheme by top executives to avoid paying personal income taxes on job perks such as rent-free apartments and luxury cars. The conviction is a validation for New York prosecutors, who have spent three years investigating the former president and his businesses, though the penalties aren't expected to be severe enough to jeopardize the future of Trump's company. As punishment, the Trump Organization could be fined up to USD 1.6 million a relatively small amount for a company of its size, though the ...

Trump Organization faces criminal tax fraud trial, hearing on Nov 3

For years, as Donald Trump was soaring from reality TV star to the White House, his real estate empire was bankrolling big perks for some of his most trusted senior executives, including apartments and luxury cars. Now Trump's company, the Trump Organization, is on trial this week for criminal tax fraud on the hook for what prosecutors say was a 15-year scheme by top officials to hide the plums and avoid paying taxes. Opening statements and the first witnesses are expected Monday in New York. Last week, 12 jurors and six alternates were picked for the case, the only criminal trial to arise from the Manhattan district attorney's three-year investigation of the former president. It's one of three active cases involving Trump or the Trump Organization in New York courts. Among the key prosecution witnesses: Trump's longtime finance chief Allen Weisselberg, who pleaded guilty and has agreed to testify against the company in exchange for a five-month jail sentence. If convicted, the T
